Pooty Poot: U.S. policies "dictatorial"

Our international reputation must be getting worse if a man who is actively consolidating power in his own country calls us out. This is the same man who Bush has nicknamed Pooty Poot. Aren't these two guys buddies? Something must have happened behind the scenes to increase tensions.

NEW DELHI (Reuters) - Russian President Vladimir Putin accused the United States on Friday of pursuing a dictatorial foreign policy and said mounting violence could derail progress toward bringing peace and democracy to Iraq.

"Even if dictatorship is packaged in beautiful pseudo-democratic phraseology, it will not be able to solve systemic problems," Putin said. "It may even make them worse."

Even though he's currently behaving like a dictator himself, he's got it right.

Jerry Falwell admits Fox deception

Sort of. Filling in for right wing moral values shmendrick Joe Scarborough (who *cough* resigned from Congress for suspicious reasons *cough*) on MSNBC, Falwell said:

"I think [Iraq] is going well. CNN doesn't always get it right, but it goes pretty well if you watch it on Fox [News Channel]."

In other words, if you watch the war (as if it's a TV show) on Fox, you're being deliberately deceived. Bravo, Jerry. But just in case you need a reality check...

Good poll, scary poll

Good poll: A new AP poll says 59% of Americans want Bush to nominate judges who will uphold Roe v Wade.

Scary poll: A Gallup poll this week found that 45% of Americans "believe that God created human beings pretty much in their present form about 10,000 years ago." And only 30% of Americans "believe that Charles Darwin's theory of evolution... has been well supported by the evidence."

Public radio reporter forced to resign

After receiving a gay-bashing spam e-mail from an ultra right organization, Rachel Buchman, a reporter for the Philadelphia NPR affiliate WHYY-FM, said what most of us would like to say to any spammer, especially an anti-gay right wing spammer. Fed up with the repeated unsolicited hate spam from Laptoplobbyist.com, she decided to leave the following message on the group's voice mail:

"I wanted to tell you that you're evil, horrible people. You're awful people. You represent horrible ideas. God hates you, and he wants to kill your children. You should all burn in hell. Bye."

Her mistake? She left her phone number with the message. So the group’s founder, Chris Carmouche, posted the message on the web and sent it to the Laptoplobbyist mailing lists. Right wing media outlets like CBN, The Washington Times, and right wing radio stations picked up the story and peppered it with snarky headlines and commentary accusing Buchman of being "hostile" and "hateful" among other things.

Sadly, Rachel Buchman has been forced to resign...

So Buchman's major trespass was leaving a private phone message (not via broadcast or publication) which employed the same language and tone which is used around the clock -- all day, every day -- on right wing talk radio and in other media around the country. Yet she's accused of being "vitriolic".

Let's do the list.

According to the Birmingham News, State Representative Gerald Allen has introduced a bill that seeks to ban from Alabama schools and libraries all books that "recognize or promote homosexuality as an acceptable lifestyle."

What to do with all the current copies of The Color Purple, Giovanni's Room, Brideshead Revisited, or local community theatre favorite, Cat on a Hot Tin Roof? Burn them, just like the Nazis used to do?

Heavens, no! Rep. Allen has a better idea: "I guess we dig a big hole and dump them in and bury them."

Dig a big hole and put things in it? What a homoerotic suggestion, Gerald! Perhaps books aren't the only thing Gerald wants to "bury."

If you envision heaven as a big mud-wrasslin' ring, then it's not a leap to imagine that St. Peter has scheduled a match between Karl Marx and Sam Walton, the founder of Wal-Mart and the man responsible for scenes like this one, captured by the intrepidly unironic folks at the New York Times.

These members of the masses above, and millions like them, all woke up when it was still dark to go down and wait for the doors to be opened at dawn.

We Hate Them For Their Freedom

No, they're not cheering because Wal-Mart opened their doors at dawn the day after Thanksgiving. That's what we cheer for in THIS country. These guys are cheering because they brought down the Ukraine government, steered by Prime Minister Viktor Yanukovich, who is alleged to be behind a rigged election.

Ah, the Ukraine, the world's shining beacon of democracy. The Ukraine, where members of the opposition party oppose the party in power; where people take to the streets to protest voting irregularities; where members of the news media actually question the stories fed to them by government officials.

Did you ever, in any remote corner of your mind, think: "Man, I want to live in the UKRAINE!"?

Keep in mind, though, they don't have Wal-Marts there that open at dawn the day after Thanksgiving.

They don't have Thanksgiving, either.

Networks controlled by White House

What happens when a large, well respected Christian group creates an advertisement promoting tolerance and acceptance of the gay community? It gets banned, of course, in an insanely twisted, dangerous, and hypocritical genuflect at the steps of the Imperial White House.

The United Church of Christ issued a press release today disclosing that CBS and NBC are refusing to air an advertisement which welcomes people of all kinds into the UCC.

According to a written explanation from CBS, the United Church of Christ is being denied network access because its ad implies acceptance of gay and lesbian couples -- among other minority constituencies -- and is, therefore, too "controversial."

"Because this commercial touches on the exclusion of gay couples and other minority groups by other individuals and organizations," reads an explanation from CBS, "and the fact the Executive Branch has recently proposed a Constitutional Amendment to define marriage as a union between a man and a woman, this spot is unacceptable for broadcast on the [CBS and UPN] networks." (emphasis added)

Incontrovertible proof that the White House, not just the intolerant right wing infrastructure, has subverted the media at the highest levels.

Two broadcast networks have refused to run a Christian advertisement simply because the message in the Christian advertisement runs contrary to the president's agenda.

It proves that the right's "moral values" posture isn't as much about the teachings of Christianity as it is about simple bigotry and hatred, as well as the entrenching of a fascist regime. Plain and simple.

The strangling of the nation by the right grows more suffocating with every passing day, and their plan becomes more clear:

Christian, liberal, black, Jew, gay, or straight. It doesn't matter. If you're not one of them, you're not anyone. You're simply... in the way.

It's the policies, stupid

The Defense Science Board, which one can assume is a division of the Pentagon hated by both Rummy and Georgie, released a report the day before Thanksgiving (great time to release reports! The usually alert media is even more alert before a big holiday!) which criticized the current U.S. wars in Afghanistan and Iraq.

The Christian Science Monitor quotes this doozy from the DSB report:

Muslims do not hate our freedom, but rather they hate our policies [the report says]. The overwhelming majority voice their objections to what they see as one-sided support in favor of Israel and against Palestinian rights, and the long-standing, even increasing, support for what Muslims collectively see as tyrannies, most notably Egypt, Saudi Arabia, Jordan, Pakistan and the Gulf states. Thus, when American public diplomacy talks about bringing democracy to Islamic societies, this is seen as no more than self-serving hypocrisy.

Yep.

Red Cross: Torture at Guantanamo

The New York Times has learned of a confidential International Red Cross memo from this past Summer which details extensive use of torture against detainees at Guantanamo. The Red Cross also discovered violations of medical ethics, though the extent of those violations are unclear. But one can only imagine. A team of psychology experts nicknamed "Biscuit" (Behavioral Science Consultation Team), which advises interrogators (torturers) about means of psychological coercion, is named in the report. From the Times:

The report of the June visit said investigators had found a system devised to break the will of the prisoners at Guantánamo, who now number about 550, and make them wholly dependent on their interrogators through "humiliating acts, solitary confinement, temperature extremes, use of forced positions." Investigators said that the methods used were increasingly "more refined and repressive" than learned about on previous visits.

A chilling comment from Guantanamo commander General Hood, "We take everything the Red Cross gives us and study it very carefully to look for ways to do our job better." Do the findings above, coupled with Hood's comment imply they're inventing better methods of torture?

One way is to allegedly attain the medical records of the prisoners and use the records as a road map for torture methods.

Leonard S. Rubenstein, the executive director of Physicians for Human Rights, was asked to comment on the account of the Red Cross report, and said, "The use of medical personnel to facilitate abusive interrogations places them in an untenable position and violates international ethical standards."

These allegations, as reported by the Times, continue:

The report said that such "apparent integration of access to medical care within the system of coercion" meant that inmates were not cooperating with doctors. Inmates learn from their interrogators that they have knowledge of their medical histories and the result is that the prisoners no longer trust the doctors.

Let's talk about the Geneva Convention...

Article 13 of the Geneva Convention clearly states:

Prisoners of war must at all times be humanely treated. Any unlawful act or omission by the Detaining Power causing death or seriously endangering the health of a prisoner of war in its custody is prohibited, and will be regarded as a serious breach of the present Convention. In particular, no prisoner of war may be subjected to physical mutilation or to medical or scientific experiments of any kind which are not justified by the medical, dental or hospital treatment of the prisoner concerned and carried out in his interest.

So what constitutes a "medical experiment"? Using "Biscuit", a medical team, as part of the interrogation process might qualify.

The Times reports, "It said the medical files of detainees were "literally open" to interrogators."

The next line from the Geneva Convention TPW makes the case even more clearly:

Likewise, prisoners of war must at all times be protected, particularly against acts of violence or intimidation and against insults and public curiosity.

Meanwhile, the Red Cross is knee-deep in internal debate about whether to go public with its entire report, which could compromise the access the organization receives to the facilities and detainees. In other words, a catch 22. If they abandon their confidentiality agreement with the government, they could stand to lose much of their investigatory power.

None of it seems to matter to the White House. Alberto Gonzales, our next Attorney General, wrote a memo which included:

The war against terrorism is a new kind of war... This new paradigm renders obsolete Geneva's strict limitations on questioning of enemy prisoners and renders quaint some of its provisions.

Download the memo (Acrobat pdf). It's a staggering claim and establishes a terrifying precedent. By establishing a doctrine whereby any law can be circumvented with the addition of the qualifier "a new kind of", the power of the Bush Empire to do anything they want is increased a thousand fold. For example, what if November 2 was redefined as "a new kind of" election?

UPDATE: Delaware River oil spill

Hundreds of birds are dead and hundreds more are coated with oil two days after a tanker dumped 30,000 gallons of oil into the Delaware River adjacent to Philadelphia. Divers have found two holes in the hull of the Tsakos Shipping tanker, which left a 20 mile trail of oil while on its way to a Citgo Petroleum facility in Paulsboro, New Jersey. KYW News reports:

[This] type of ship is planned to be barred from U.S. waters within seven years because of safety concerns. Environmental groups have long warned that single-hulled oil tankers like the Athos I are less able to withstand accidents than double-hulled ships with a second layer of steel protecting their tanks.

Tsakos officials say the ship probably hit something. They're smart!

The good news for Tsakos is that they're probably loaded with protections to cover any liability as the result of the incoming deluge of criminal and civil charges. Good for them. And it gets better. Tsakos' usage of cheapo, obsolete single-hulled tankers saves them a bundle. In fact, they made record profits this year. $215 million dollars worth. The Motley Fool is calling them an attractive stock. Why not send them an congratulatory e-mail at their site. Feel free to start the e-mail with something like: "Congratulations, you filthy rat bastards..."

Rumsfeld to be charged with war crimes

The New York based Center for Constitutional Rights is filing war crimes charges against Donald Rumsfeld, George Tenet, Undersecretary of State Stephen Cambone and seven other senior U.S. officials. The charges are being filed in Germany, which is said to have leading-edge laws regarding international crime and can prosecute defendants no matter where they reside. From the CCR press release:

In a historic effort to hold high-ranking U.S. officials accountable for brutal acts of torture including the widely publicized abuses carried out at Abu Ghraib, on Tuesday November 30, 2004, CCR and four Iraqi citizens will file a criminal complaint with the German Federal Prosecutor’s Office at the Karlsruhe Court, Karlsruhe, Germany. Under the doctrine of universal jurisdiction suspected war criminals may be prosecuted irrespective of where they are located.

Much like Jim Garrison's prosecution of Clay Chaw in the JFK assassination conspiracy, this is a small first step in a much larger battle to hold accountable those who sanctioned torture at Abu Ghraib. None-the-less, it's a safe bet that Rumsfeld and company will walk away from this, that is if they even notice they've been charged with something. More details are to be released on Tuesday.

Supreme Court forgoes anti-gay appeal

Poor, poor conservatives. Unable to show any sort of injury or violence at the hands of the Massachusetts court ruling which allows gay marriage, the right wing challengers' appeal to the U.S. Supreme Court has been rejected by the justices. The highest court has refused to even hear the case.

Prior to the U.S. Supreme Court decline, Mathew Staver, the President of the conservative Florida-based Liberty Counsel who filed the challenge, compared the Massachusetts court ruling to "tyranny". On the Liberty Counsel website, Staver makes a case against the courts despite their crucial role in checking laws for Constitutionality, as is clearly established by the Framers.

His cherry picked clause? The Guarantee Clause (section 4) in Article IV which says:

The United States shall guarantee to every State in this Union a Republican Form of Government...

In other words, a government elected by the people. Staver believes the courts don't directly represent the people and therefor shouldn't be allowed to establish laws and "tyrannize" the people. They, in fact, don't. They check laws and rule them Constitutional or not. But here's the kicker. And this is why the Supreme Court is ignoring the suit. Article IV, section 4 continues:

...and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence.

Violence. Again, conservatives showing their aptitude for neglecting whole parts of Constitutional clauses (the "militia" section of the Second Amendment being another example).

Why is this loss significant for the anti-gay movement? The Supreme Court just fired a flare over the bow of the right's war ship. If any futher challenges are filed, the Supreme Court -- even though it currently holds a conservative majority, will very likely reject any anti-gay-marriage suits.

That's why the right's only option is a desperate Constitutional Amendment defining marriage. In response, how about an Amendment defining "freedom", "liberty", and "equal protection". Which would be a waste of time since THEY'RE ALREADY GUARANTEED BY THE CONSTITUTION. The 14th Amendment:

All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

Perhaps you could call the Liberty Counsel and read the 14th Amendment to them. Their phone number is (407) 875-2100. Remind them that although the Constitution guarantees freedom of religion, it doesn't sanction the restriction of freedoms based on Biblical law.

Publius, meet Leviticus

The second half of Meet the Press was atrocious today. The topic: separation of church & state and "moral values". The panelists: divorced gay-bashing televangelist Jerry Falwell; Bush appointee and woman-basher Richard Land of the Southern Baptist Convention; anti-war anti-poverty moderate Jim Wallis of Call to Renewal; and Reverend Al Sharpton.

Here's a thumbnail of the discourse. Right off the bat, Wallis had very little to say other than one or two commendable mini-statements against war and poverty. Falwell defended his post-9/11 opinion that lesbians and secularists are to blame for the attacks. Sharpton began by jovially talking about bets and steak dinners with Falwell (Land condemned Al and Jerry's wager on the presidential election) just after prefacing his entire position by saying, "I may agree with Reverend Falwell on many issues." And Dickland made a case for a husband's God-given right to prevent his wife from working outside the home and that the Bible mandates women as servants.

The ridiculous discourse aside, is this a representative panel? Two evangelical Christians (Wallis and Sharpton) and two psychopathic evangelical Christians (Falwell and Land)? More below the fold.

If Tim Russert meant to host a truly balanced debate about religion and politics, he should've began with a two-way panel composed of a strict constructionist Constitutional scholar and an pro-judicial-activist Constitutional scholar. Both with religious affiliation, but neither as spokesmen for specific organizations. Half hour of straight up debate between two people who don't have any political or fund-raising axes to grind. Then Russert should've filled out a second panel with one Christian southern evangelical, one Jewish leader, one Muslim leader, and one secularist Congressman with no religious affiliation.

Instead, Russert has managed to augment the bubbling global perception that America is the land of radical Christianity. What other signal does it send other than "the only people who have insight on moral issues are Christians"? It also stands to reason that many mainstream Christians tuning into the show do not endorse the fringe doctrine of Land or Falwell. So why does the press lend validity to these lunatics by placing them on what's widely considered to be the most reputable political news show on television?

So many questions with one significant answer. The theocratic movement has been so successful that it's infiltrated the mainstream discourse and its formerly marginalized representatives have gone from fringe punchlines to qualified experts. This success is based solely on a disciplined infrastructure of tenacity, bottomless war chests, and subversion of the free press. Now, instead of hearing from different sides, we get different degrees of the same side.

If there is to be a national debate about the future of the Constitution, let's talk about the Constitution. Let's talk about the Framers. Let's talk about separation of church and state. There's an enormous population of publish-or-perish Constitutional scholars out there to choose from. But by padding the debate strictly with Christian ringers fed to the press by Christian right think tanks, the Constitution slowly becomes a footnote, and the Bible takes over -- whether it's the rule of law or not. That's the first step on a path towards a Christian reconstructionist theocracy. Publius, say hello to Leviticus and the end of America as we know it.

ELECTIONS: Everyone is stupid except us

Saturday, the Ukrainian Parlaiment rejected the highly tainted results of their presidential elections amidst Pelenor Fields-sized protests, ballot stuffing accusations, exit poll irregularities, and a conventional wisdom that indicates the incumbant, Viktor Yanukovych, isn't the favorite of the majority of Ukrainians. Meanwhile, the state run press who previously gave unwavering support to Yanukovych has decided to endorse the opposition and challenger Viktor Yushchenko (who is either being poisoned or is very, very ill).

Is the Ukraine looking appealing right about now? The election news there is all too familiar here -- except that we don't have the massive vigils and protests; only small factions of our legislative branch are acting; and the media has laughed off the issue with barely more than a couple of ho-hum column inches.

Today, Bush said this about the Ukrainian crisis, "There's just a lot of allegations of vote fraud that placed their election, the validity of their elections, in doubt." Is he talking about our elections or their's?

Apparently, we in America have the whole election/democracy thing down pat and the Ukrainian system is a wreck. In terms of the elections themselves we're on equally ridiculous footing.

However, the reactions in the respective aftermaths are as different as night and day, and we're the night.

The major difference between us and them is that they actually seem to care about democracy -- at every level. Look at the protests. Even in 2000, nothing like that happened here. And those of us here who actually do care about the veracity of our electoral system (if you can call it that) are assigned Chicken Little status. The idear of exporting democracy around the world seems to be seriously draining our own supply here at home.
