What if The Supremes Kill It?

I have no idea what hour the decision will be handed down, but it's important to highlight what's at stake if the conservatives on the Supreme Court kill the ACA. ThinkProgress summed it up nicely.

Every year, hundreds of thousands of Americans file bankruptcy because they cannot afford their medical bills. Thousands more are locked into jobs their hate because they cannot risk losing their employer-provided health insurance while they have a preexisting condition. According to one study, about 45,000 people die every year because they do not have health insurance.

That last number? That's more than a new 9/11 every month. As I've said repeated over the years, if health insurance premiums and costs were terrorists, the Republicans would have passed single-payer by now -- yes, the Republicans.

As I'm writing about for my column today, if the law falls today -- no, healthcare legislation will not become more liberal. It will only become more piecemeal and conservative. That's been the trend every time someone tries to change the system and fails.

Hang on tight.

Um…didn’t the Republicans–at least backhandedly–already pass the ACA? After all, most of the provisions, including the individual mandate, came out of the Heritage Foundation…

    • D_C_Wilson

Yeah, but Obama has atheistmuslimsocialist cooties, so that’s why their opposition to the individual mandate is totally different from their previous support for it.

I am willing to be pleasantly surprised if the ACA bill accomplishes all Obama and the Democrats claimed it would, though from a cost standpoint, CBO estimates don’t convince me that going forward this won’t be just one more long-term budgetary boondoggle. All the talk about cutting the deficit is just that – talk, and gimmick. It’s pretty clear that nobody really knows what the ultimate effect of ACA will be.

The court has said that congress does not have the right to order individuals to purchase health insurance, but that it has the right to tax individuals who choose not to purchase it.

    What a deal.

Justice Roberts – the new swing vote. Who knew?

    • bphoon

      Blah. Blah. Blah.

    • nicole

Have you always been so unwilling to concern yourself with the well being of your fellow man, Joseph? Stupid question, I know.

I have no hope that Roberts is now a swing vote. My belief is that he voted with the libs this time because he was concerned about how historians would view his court.

  • nicole

WOOHOO!! :) Thus far, mandate upheld!!

  • nicole

1 more decision to be read, and then health care.

  • Lazarus Durden

I’m calling it 6-3 in favor of the Mandate. Roberts will cross with Kennedy. I seriously don’t think even the Court is that stupid to shoot the conservative agenda in the foot. If they were to rule against the Mandate so many other things would go bye, bye like privatizing social security and medicare. They don’t wanna set that precedent. Their corporate masters wouldn’t like it.

Also I disagree Bob if ACA is struck down there would be a massive backlash that would push for a more government focused healthcare system. Simply because there would be no other option left. Going back isn’t an option.

    • i_a_c

      We have a winner!

Kennedy didn’t cross over with Roberts but almost nobody expected this result.

      Hot damn.

      • Lazarus Durden

Close. I was off by a Kennedy. Honestly after reading his decision how is he considered a swing justice again? This ruling is a clear cut case on why President Obama getting re-elected is so important. One more conservative on the SCOTUS and we can start kissing the progressive agenda goodbye.

Man, hyperbole doesn’t help. By suggesting that if health insurance premiums/costs were terrorists, that only then would the GOP act, you go too far. Just tone down the rhetoric. I mean, all you really needed to say was if health insurance premiums and costs were in this country illegally from Mexico, or that they’re black and they knocked up your daughter, THEN the GOP would move heaven and earth to do something about it. See the difference? I’m here to help.

    • Kitty Smith

Next, Zirgar will regale us with a rousing speech about how you would be more effective if you weren’t so MEAN to Romney…
