Kobach: It’s Possible Obama Will Make Black People Immune to Prosecution

Written by SK Ashby

Is it possible that the Obama administration will arbitrarily decide that black people should be immune from prosecution?

No, obviously not, but Kansas Secretary of State Kris Kobach seems to think so.

After a caller told Kobach on his radio show that black people are "not going to be prosecuted, regardless of the crime," Kobach agreed that it has sort of, kind of, maybe already happened except not really.

Holder, Kobach agreed, “basically made it clear….that the civil rights laws were only to protect minority races, and he was not going to be enforcing them to the benefit of white people who were discriminated against on the basis of their race. So, that’s basically what you’ve described.

So the word is going to come down that there just won’t be any prosecutions of black criminals,” [caller] Stu predicted. “And I can see it happening. I don’t think I’m nuts for envisioning it.”

Well, it’s already happened more or less in the case of civil rights laws,” Kobach responded. “So I guess it’s not a huge jump, I think it’s unlikely, but you know I’ve learned to say with this president, never say never.”

Given that we all know the Civil Rights Act was not passed to protect the oppressive majority (straight white men), I'll just marvel at the idea that the administration would or could declare that black people are immune "regardless of the crime."

You would be right to say that, as a secretary of state, Kris Kobach has a responsibility to explain that this is not actually possible and is not happening, at least not in his state, but instead he chose to say that it's already happening.

I can't even imagine how hilariously absurd this notion must be to black people across the country who are subjected to the kind of discrimination and brutal policing unveiled by the Department of Justice in Ferguson this week.

There are people in this country (mostly white people) who live in a right wing fantasy land where up is down, left is right, and white people are an oppressed minority. There are people who actually believe this shit. Legions of them. They occupy an alternate universe where The Rock Obama has torn the Constitution to pieces and suspended the rule of law.

The Rock

If white people do become an oppressed minority sometimes in the late 2050s or 2060s, let it be known that we deserve it.

We can laugh at rubes who call into hate radio shows, but it's an all too real possibility that elected officials who legitimize these delusions could incite hate crimes.

As you may recall, Kris Kobach has been described as the father of "Papers Please" anti-immigration law. You could say he's something of an expert on violating civil rights.
