Kansas Might Make it Almost Impossible to Change Transgender Birth Certificates

An increasing number of other Republican-run states are lining up to discriminate against transgender men and women, so why not Sam Brownback's Kansas?

State authorities are considering new rules that would make it extremely difficult if not totally impossible for a transgender person to update a birth certificate to reflect their identity.

Reading this was not the first time I cursed at my screen today, but it may have been the loudest.

The department's revised rules would allow a change only if a person or his or her parents could document that the gender was incorrectly recorded at the time of birth. [...]

Republican Kansas state Sen. Mary Pilcher-Cook said a birth certificate is "a record for future generations" and shouldn't be changed lightly. She said the document should reflect the "science" behind a person's gender and not "political purposes."

The "science."

Republicans wouldn't know science if Sir Isaac Newton's apple hit them on the head. They don't care about the science behind transgender identity, or homosexuality, or climate change, or evolution, or abortion, or even the goddamn tides.

"Tide comes in. Tide goes out. You can't explain it."

You can bet their criteria for documenting that a gender was "incorrectly recorded" is just as nonsensical and scientifically-challenged as their views on basically everything else.

Lawmakers in other states pushing anti-transgender legislation have said transgender people should undergo reassignment surgery and update their birth certificates if they want to use an appropriate restroom but, as lawmakers in Kansas have now shown us, that will be the next thing they come for.

They want to legislate transgender people out of existence or at least out of all public sight.

    Kansas has achieved what would have been considered impossible just a few years ago; to-wit: Making Missouri look like a liberal stronghold in comparison.

    The two states never could stand each other.

    This is just repulsive. The GOP is absolutely determined to harass a group of people who have done nothing wrong and who, to be blunt, have been handed by life itself more to deal with than most of us ever have to even think about.

    First of all, the republican governors are hastily passing these laws to thwart municipalities and counties who accept transgender people and acknowledge that this is a non issue.
    It’s about power and control because the conservative leaders know they can always depend on the support of bigots and hate-filled superstitious perverts.

    Health department officials contend the issue about birth certificates has arisen because of a 2002 state Supreme Court decision.

    The court ruled on the legality of a transgender woman’s 1998 marriage to a man in Leavenworth County, in a dispute over the man’s estate after his death. The court said the marriage wasn’t legal under the state’s same-sex marriage ban because she’d been born male and remained male “for the purposes of marriage.”

    The state has interpreted that ruling to mean a person can’t legally change their gender at birth and therefore can’t revise their birth certificate, absent an absent an actual mistake.

    Brownback spokeswoman Eileen Hawley said state law allows only minor changes in birth certificates and, “changing the sex designation is not a minor change.”

    The health department’s proposed changes would eliminate a regulation allowing transgender people to update the gender listed on their birth records by providing “a medical certificate” documenting “a physiological or anatomical change.”

    This is equal parts bigotry, bullying and ignorance, There is no rational purpose served by this. Hell, there’s barely an irrational purpose served.

    This is the new version of ‘the closet’. Which is kind of ridiculous. Since transgender people only wish to settle into their lives quietly as the people they are. They don’t do marches or ‘act up’. They just want to live their lives in peace and pee in peace. I don’t think that is a lot to ask of society. It is part of that pursuit of happiness thing.
