The Birthers Are Eating Each Other Alive

While Ted Cruz continues to face accusations that he is not actually eligible to become president of the United States, fellow senator and GOP presidential candidate Marco Rubio is facing a lawsuit from one his own constituents in Florida.

This week Rubio sought to have a court complaint in Florida against him thrown out, saying the argument “would jeopardize centuries of precedent and deem at least six former presidents ineligible for office.” [...]

Rubio filed a motion to dismiss on Jan. 11. The 34-page filing, heretofore unknown, shows that Rubio’s legal team spent considerable time researching the issue. “Senator Rubio is a natural born citizen of the United States and he is eligible to be President of the United States,” it concludes.

Rubio's legal team is correct. Rubio was born in Miami which makes him a natural born citizen even if his parents were not.

The chickens are coming home to roost for the GOP, a party which just recently indulged the idea of ending birthright citizenship under the Fourteenth Amendment of the Constitution.

The Republican party opposes the Fourteenth Amendment for many reasons unless they can use it to their advantage. Republicans will tell you gay couples, for example, do not deserve equal protection under the law, but others, such as Mike Huckabee, have said unborn fetuses deserve citizenship and equal protection under the law.
